
TERMS AND CONDITIONS
Services Provided and Client Responsibilities: The Company agrees to provide
comprehensive maintenance, preventative maintenance, repair, and renovation
services for the client’s swimming pool. These services may include, but are not limited
to, recurring cleaning service, chemical testing, monitoring and balancing, equipment
inspection, specialized chemical treatments, client-approved repairs, and pool
renovations. Details of these services are outlined in the maintenance agreement,
preventative maintenance agreement, and/or signed estimate for repair and renovation
projects. Renovation services may encompass pool resurfacing, tile replacement,
equipment upgrades, and other agreed-upon renovations to enhance the aesthetics and
functionality of the pool.
The Client shall fulfill the following responsibilities to ensure smooth and efficient service
delivery:
a. Provide Pool Centurion with clear and unrestricted access to the swimming pool
and its equipment during scheduled maintenance visits.
b. Promptly notify Pool Centurion of any issues, concerns, or changes related to the
pool or its equipment.
c. Cooperate with Pool Centurion’s reasonable requests for information or
assistance in carrying out the agreed-upon services.
d. Ensure that the pool’s water level is maintained appropriately. The Client is
responsible for adding water to the pool when necessary. If the Client is unable
to do so, they should provide a functioning pool autofill system or a hose and
water timer for automatic water refilling. Pool Centurion will not be responsible for
adding water to the pool or for any water consumption resulting from failed
autofill systems or water timers provided by the Client.
Inclement Weather: Pool Centurion understands that inclement weather, including
heavy rain, lightning, and strong winds, can occur and may make it unsafe to carry out
the full range of pool maintenance tasks. During such weather conditions, the safety of
our team and clients is our top priority.
In the event of inclement weather, where it is deemed unsafe to perform certain
maintenance tasks, Pool Centurion will take proactive measures to ensure the chemical
balance and water quality of your pool. Although our team will make efforts to add the
necessary chemicals to maintain water quality and prevent potential issues caused by
the inclement weather, it may be required to utilize a specialized chemical treatment
outside the normal course of service to bring the pool into proper balance. Rest assured
that despite any service interruptions, we are committed to safeguarding the health and
condition of your pool.
Arrival Policy: Properties are all on a set schedule and performed within a route. Most
residential pools are promised to be cleaned each week. This varies with commercial
properties. The Customer Service Department and the Technicians will change the
schedule to accommodate your upcoming arrivals – within reasonable notice. Any
additional cleaning outside of the regularly scheduled maintenance is an extra cleaning
charge, as determined by Reef Tropical, Southwest Pools, Naples Pool Service, & Pool
Service Plus powered by Pool Centurion Group, LLC staff. We will do our best, at our
discretion and as a courtesy, to adjust the route schedule prior to arrival. Unfortunately,
this does not work in all cases.
Recurring Service Agreements – Automatic Renewal: All recurring service
agreements will automatically renew under the same terms unless either party provides
written notice of their intent to modify or cancel the agreement. Notice must be
submitted at least thirty (30) days prior to the annual renewal date.
Example: If the original agreement start date is June 1, 2024, written notice must be
received by May 1, 2025 to prevent automatic renewal.
Cancellation Policy: Customers may cancel maintenance service at any time.
Cancellations will be effective by the end of the current billing month.
If a customer experiences a service quality concern, they must allow Pool Centurion
three (3) business days to investigate and correct the issue before requesting
cancellation. We are committed to resolving any service issues promptly and
professionally.
There are no refunds for monthly prepaid maintenance services. Upon
cancellation, a final statement will be sent to the client, and any outstanding balance will
be charged to the payment method on file.
Pool Popping and Structural Risk: Customer acknowledges that pools are
susceptible to hydrostatic pressure and ground water table fluctuations, especially
during renovation, leaks, autofill malfunctions, storms, or any drop in water level. This
can result in severe structural issues such as pool “popping” or lifting.
Pool Centurion is not responsible for any structural damage caused by
hydrostatic pressure, low water levels, or failure to maintain water level or
drainage. To reduce this risk, clients must: - Maintain proper water levels at all times;
- Notify us immediately of any water loss or drainage issues;
- Allow access to systems required to manage or monitor water levels.
Payments Accepted: ACH or credit card is required on file at all times for all
customers. All recurring memberships require a credit card on file. We do accept
payments through ACH or e-check as long as there is a credit card on file for repair and
renovation projects.
Maintenance Payment Schedule: Unless otherwise specified, all invoices are due on
receipt. Payment on file will be charged when the invoice is issued.
Repairs Payment Schedule: All invoices are due at the completion of the work being
performed unless otherwise specified. Any repair projects over $1000 will require a 50%
deposit to begin work. Payment on file will be charged at the completion of work.
Renovation Payment Schedule: The payment schedule will be specified in the
proposal and signed agreement. If the proposal or agreement does not include a
payment schedule, payment is due in full upon signing. Customers may opt to pay for
their renovation project with a credit card, but a 3% fee for credit card processing will be
applied to the invoice or charged at a later date. Payment on file will be charged based
on the agreed-upon schedule.
If any balance due to the Contractor is not paid within 30 days of the Contractor’s
invoice, the Customer shall be considered in default.
Delinquent Accounts: Reef Tropical, Southwest Pools, Naples Pool Service, & Pool
Service Plus powered by Pool Centurion Group, LLC reserves the right to initiate
collection procedures if the customer’s account is 30 days past due. We will attempt to
collect past due amounts first by phone and then via email. Customer shall be
responsible for interest at 1.5% per month (18% annually) and any legal fees or
collection costs incurred.
If the account remains delinquent after 60 days, a final notice will be issued and
services may be cancelled. Non-payment or late payment may delay project completion
and result in service interruption.
Lien Rights: In accordance with Florida law, Pool Centurion reserves the right to file a
construction lien against the property for unpaid balances related to renovation or repair
work. This includes any materials, labor, or services provided under a signed estimate
or agreement. Failure to remit payment as outlined may result in legal action to secure
the outstanding debt through lien enforcement.

powered by Pool Centurion Group, LLC is not responsible for any damage caused by
acts of nature, fire, vandalism, misuse, abuse, or customer negligence. We are not
liable for damage to property from chemicals not sold by us or deterioration of
equipment from age, chemical exposure, or sunlight.
Third-Party and Self-Performed Work: Pool Centurion is not responsible for any
issues, damages, or performance deficiencies resulting from repairs, renovations, or
modifications performed by the customer or any third-party contractor not authorized or
hired by Pool Centurion. Any such work voids our responsibility for related system
performance, water quality, or structural integrity.
We are not responsible for structural issues, including pool shell movement or popping,
due to hydrostatic pressure, drainage failure, or low water levels beyond our control.
Service Review and Acceptance: Customers must report any concerns about
completed recurring maintenance services within 24 hours of the visit. For all repairs,
renovations, or non-routine work, written notice of any issues must be submitted within
72 hours of completion. Failure to notify us within these timeframes will constitute
acceptance of the work performed.
Insurance: The Contractor shall carry standard workers compensation and general
liability insurance. Customer agrees to look solely to the Contractor’s insurance for any
claims related to the work performed.
Working Conditions: Customer is responsible for identifying and disclosing any site
conditions, utilities, or hazards prior to service. The Contractor is not responsible for
unsafe or improper conditions and reserves the right to refuse work until such conditions
are remedied.
Chemical Damage: Chemicals used in and around water features are corrosive and
can cause damage to surfaces such as flooring, carpets, drywall, decking, and adjacent
areas. Pool Centurion is not responsible for damage caused to any surface, including
wood decking, due to chemical exposure, splashing, or overflow.
We recommend the use of deck materials that are sealed, stain-resistant, and chemical-
resistant. Customers are required to provide a direct, unobstructed path from the
service access point to the body of water that meets these conditions. Without these
precautions, the customer accepts full responsibility for any damage caused by
chemical handling or water transfer
Jurisdiction Venue: This agreement is enforceable in all Florida Counties.
